Quote from Roman on February 12, 2025, 8:57 pmI have a 2nd NPN that has an opportunity date to sue for foreclosure coming up on December 4, 2025.
On the 1st NPN, the borrower lost the lawsuit and the current status of the lawsuits:
"ORDER JUDGEMENT 236 was executed on August 7, 2024."
I didn't find the house on Sheriff's sale and to understand when the auction date, I contacted the county prothonotary.
She told me by phone that there is another action pending on the part of the borrower, but I din't really understand her what exactly it is (I didn't record that call). I remember she said something about “to reduce...” and that it could be looked up in the county's public records of the foreclosure proceedings. Here's my question: what are the odds that the borrower will be able to settle with the 1st NPN holder before auction day, and I will be past the date I can file for foreclosure?
Should I file for foreclosure now as a 2nd NPN holder?
The borrower is still not responding me.
I tried to call his attorney, but there was an answering machine and no one has called back yet.
